Service Terms and Public Offer Agreement

1. General Provisions
1.1. This document constitutes a Public Offer Agreement (hereinafter referred to as the "Agreement") issued by OPEN VIRTUAL ARENA OVA LTDA (hereinafter referred to as the "Company", "we", or "us") for the provision of virtual reality (VR) services.
1.2. The Agreement is legally binding for any individual or entity (hereinafter referred to as the "Client", "you", or "user") who books, pays for, or participates in our services.
1.3. Acceptance of this Agreement occurs at the time of confirming a booking, making a payment (online or in-person), or using the service.
1.4. By accepting this Agreement, the Client confirms they are fully aware of and agree to all terms and conditions described herein.
2. Service Description
2.1. The Company offers recreational VR experiences at its physical location, including but not limited to room-scale VR games, multiplayer scenarios, and private bookings.
2.2. Service availability, content, duration, and pricing are described on our official website and/or booking platforms.
2.3. The Company reserves the right to modify available experiences, session durations, or pricing without prior notice, while honoring existing confirmed bookings.
3. Age Restrictions
3.1. Minimum age to participate: 8 years old.
3.2. Children under 14 years of age must be accompanied by a parent or legal guardian.
3.3. The Company reserves the right to refuse service if age restrictions are not met or if supervision requirements are not fulfilled.
4. Booking, Payment, and Cancellation Policy
4.1. Clients may book services through our website, approved third-party platforms (e.g., EasyWeek), or directly at our venue.
4.2. Prepayment may be required to confirm a booking.
4.3. If a cancellation is made less than 2 hours before the scheduled session, the prepayment is non-refundable.
4.4. Late arrivals of more than 10 minutes may result in reduced playtime without compensation.
4.5. No-shows without prior notice are considered forfeitures of service.
5. Client Responsibilities and Conduct
5.1. Clients must follow all safety instructions and behavioral guidelines provided by staff.
5.2. Participation under the influence of alcohol or drugs is strictly prohibited.
5.3. The Client is responsible for any damage caused to equipment due to negligence or improper use.
5.4. Offensive behavior, including verbal abuse, physical aggression, or disruption of service, may result in immediate termination of the session without refund.
5.5. The Company is not liable for lost, stolen, or unattended personal belongings.
6. Health and Safety Disclaimer
6.1. Some VR experiences may cause motion sickness, dizziness, or other forms of discomfort.
6.2. Participation is voluntary and at your own risk. Clients should consult a physician if they have any health concerns.
6.3. Clients must immediately notify staff if they feel unwell during a session.
7. Photo & Video Use
7.1. Photography and video recording are permitted for personal use only, as long as it does not disturb others.
7.2. We may take photos or videos inside our venue for promotional purposes.
7.3. If you do not consent to being filmed or photographed, please inform a staff member upon arrival.
8. Personal Data and Privacy
8.1. By using our services, you consent to the collection and processing of your personal data as described in our [Privacy Policy].
8.2. We collect only the necessary information for service delivery and customer communication.
8.3. Your data is not shared with third parties except as required by law or for payment processing.
9. Governing Law and Dispute Resolution

9.2. In the event of a dispute, both parties agree to attempt informal resolution before initiating formal legal procedures.
10. Final Provisions

10.2. The Company reserves the right to update these terms. Continued use of services after changes constitutes acceptance of the updated terms.
